Sub: Amendment of import policy of Petcoke

Dear Member,

Vide Notification No. 38/2015- 2020 dated 28th September, 2018, O/o DGFT has added graphite electrode industry to the existing four industries i.e. cement,  lime kiln, calcium carbide and gasification industries in the Policy condition No. 6 of Chapter 27 under ITC (HS) 2017. The industries given in the Policy Condition No. 6 can import Petcoke freely.

In this regard, the Council had earlier issued Circular No.ES/166/2018-19 dated August 18, 2018  wherein O/o DGFT had inserted Chapter Policy Condition No. 6 in Chapter 27 of ITC (HS) 2017 relating to Mineral fuels, mineral oils and products of their distillation; bituminous substances; mineral waxes., under Schedule 1 (Import Policy) vide Notification No. 25/2015- 2020 dated 17th August, 2018.

Import of pet coke for fuel purpose is prohibited. However, import of Pet coke is “free” for cement, lime kiln, calcium carbide and gasification industries for use as feed stock or in the manufacturing process only on Actual User basis. Ministry of Environment, Forest and Climate Change, in consultation with Customs and Directorate General of Foreign Trade, will bring out detailed guidelines on regulating and monitoring the imported Petcoke.

Import of pet coke for fuel purpose is prohibited. However, import of Pet coke is “free” for cement, lime kiln, calcium carbide, gasification industries and graphite electrode industry for use as feed stock or in the manufacturing process only on Actual User basis. Regulation and monitoring of such imports will be as per the guidelines of Ministry of Environment, Forest and Climate Change issued vide O.M. No. Q–18011/54/2018-CPA dated September 10, 2018.
