!!! Trade Alerts !!! Amendment in Handbook of Procedures of FTP 2015-20

The DGFT has notified following amendments to Handbook of Procedures of FTP 2015-20 which shall be come into force with effect from 1st April, 2015:

The Relevant ones are given below

(1) Amendment in paragraph 1.07 regarding separate applications from EDI and Non EDI ports.

(2) Amendment in paragraph 2.59 which shall substitutes Appendix 2 I from Appendix 2 G inthe Services of Inspection and Certification Agencies

(3) Amendment in paragraph 2.108(d) of the criteria in the Rules of Origin (Non-Preferential)

(4) Amendment in paragraph 4.37(a) wherein in the list of Sea Ports “Paragraphdeep” may be read as “Paradeep”.

(5) Provisions of Facility of Clubbing of Authorisations under Para 4.38 of HBP have been modified and revised.

(6) Amendment in paragraph 4.42 regarding Export Obligation (EO) Period and its Extension wherein No additional extension beyond 12 Months will be allowed by RA under any circumstances.

(7) Amendment in paragraph 7.02(c) refers to Criteria for claiming benefits in which Terminal Excise Duty (TED) refund for supply of goods to an EPCG Authorisation holder may be made to RA on the basis of Invalidation letter.

(8) Amendment in paragraph 9.10 refers to Time Bound Disposal of Applications is being modified and a new category is added.

(9) DGFT has clarified and amended HBP Para 1.05 (b) on the issue of filing of Status Holder Application (ANF 3C) / Bond Waiver Application (ANF 4F) and Nominated Agency Certificate (ANF 4I) can be made manually till EDI Online module is ready or upto 30th September 2015 whichever is earlier.

(10) DGFT has amended HBP Para 3.19 (a) regarding validity of Status Holder Certificates issued under FTP 2009-14 to extend the date from 30th June 2015 to 30th Sept 2015 or till issuance of new status certificate.

(11) HBP Para 2.84 on free of cost exports for Status holder has been amended and will now read as “Status holders shall be entitled to export freely exportable items on free of cost basis for export promotion subject to an annual limit of Rs. 10 lakh or 2% of average annual export realisation during preceding three licensing years, whichever is lower”.
