Relief in Average Export Obligation in terms of Para 5.19 of HBP of FTP 2015-20

Sub: Relief in Average Export Obligation in terms of Para 5.19 of HBP of FTP 2015-20

Dear Member,

This is to inform you that DGFT has issued Policy Circular No. 31/2015-20 dated 26th February, 2015-20 providing relief to certain products which experienced a decline in exports by more than 5% in 2018-19 as compared to 2017-18 along with list of the said products (Full list enclosed in the Policy Circular).

List of relevant products as given in Policy Circular No. 31/2015-20 which pertains to MMF Textile Sector & experiencing a decline in exports is as follows:-

DGFT has requested its Regional Offices the following –

  • To re-fix the annual average export obligation for EPCG Authorizations for the year 2018-19 accordingly.

  • Reduction, if any, in the Export Obligation (EO) should be appropriately endorsed in the licence file pertaining to the concerned EPCG Authorisation, as also in the Amendment Sheet to be issued to the EPCG Authorisation holder.

  • Regional Offices, while considering requests of discharge of EO will ensure that in case of shortfall in EO fulfillment, Policy Circulars earlier issued in terms of Para 5.11.2 of HBP 2009-14, and Para 5.19 of Hand Book of Procedures of FTP 2015-20 are also considered before issuance of demand notice etc. This stipulation should also form part of Check Sheet for the purpose of Export Obligation Discharge Certificate (EODC).
