  Sub: In partial modification of Public Notice No. 21/2020 dated 03.04.2020 namely “Measure to facilitate trade during the lockdown period – Section 143AA of the Customs Act, 1962” 

 

Dear Member,

 

Mumbai Customs has issued Public Notice No.29/2020 dated 22nd April, 2020 on the above subject.

 

Your kind attention is invited to the CBIC’s Circular No.17/2020-Customs dated 3rd April, 2020 and Public Notice No. 21/2020 dated 3rd April, 2020 through which relaxation was given to accept an undertaking in lieu of a bond required during Customs clearance upto 30th April, 2020. Now attention is being invited to Board Circular No.21/2020-Customs dated 21st April, 2020 issued on the above mentioned subject. 

 

In light of the recent announcement by the Government extending the lockdown till 3rd May, 2020 and taking into consideration that it might take sometime after the end of the lockdown for the situation to normalize, the Board has decided to further extend the facility of accepting undertaking in lieu of Bond for the period till 15th May, 2020. 

 

While the above-referred lockdown is presently in force 3rd May, 2020, considering that the importer/ exporter may find it difficult to comply with the requirement of furnishing bond for some more time thereafter till the situation normalizes, the said relaxation shall be available up to 30th May, 2020. This relaxation shall however be subject to review by the Board at the end of the lockdown period. 

 

Furthermore, the undertaking in lieu of Bond is to be submitted by the registered mail ID of the IEC holder or their authorized Customs Broker. All the Importers and Custom Brokers must tupload Undertaking on e-Sanchit also.

 

With the exception of above mentioned para i.e. Para 3, all other conditions underlined in Public Notice No. 21/2020 dated 3rd April, 2020 stand as they are. 

 

Importers /Exporters availing this facility shall ensure that the undertaking furnished in lieu of bond is duly replaced with a proper bond before the stipulated period i.e. 30th May, 2020. Customs field formations shall maintain a record of all cases of relaxation allowed by them.
