Sub: Implementation of the hazardous and other wastes (Management of Trans-boundary Movement) Rule, 2016

 Dear Member,

Mumbai Customs has issued Public Notice No. 131/2016-17 dated 19.10.2016 regarding the implementation of the Hazardous and Other Wastes (Management and Trans- boundary movement) Rules, 2016. In this connection, attention is invited to Notification No. GSR 395(E) dated 04.04.2016 issued by the Ministry of Environment, Forests and Climate Change (MoEF & CC) on the above subject.

Also, CBEC has issued a Circular vide Instruction F. No. 401/26/2014- Cus- III(Pt.) dated 30.09.2016  regarding decision  of MoEF & CC taken at the 55th meeting of Technical Review Committee held on 27th and 28th June, 2008 regarding validity of licenses of import of plastic and PET scrap issued under previous Hazardous Waste (Management, Handling and Trans- boundary Movement) Rules. 2016. These licenses will be treated as legal documents.  However, the import will be limited to the following four categories as on date of issue of the office memorandum.

  1. Those consignments which have arrived under the valid licenses on Indian ports.
  2. Those consignments under valid licenses which are in transit from the country of origin.
  3. The quantity of import for which Letter of Credit (LC) has already been opened by valid license.
  4. The quantity of import for which advance has already been paid with documentary evidences. However, in this category the quantity permissible for import will not be the entire quantity for contract against which the dvance is paid but the quantity would be limited to the value of advance paid.
