Request for Discontinuation of High Seas Sale (HSS) Registration at Import noting Section Air Cargo Complex, Mumbai

Sub:  Request for Discontinuation of High Seas Sale (HSS) Registration at Import noting Section Air Cargo Complex, Mumbai

Dear Member,

Air Cargo Complex (Sahar) has issued Public Notice No. 42/2017 dated 24.11.2017 regarding request for discontinuation of High Seas Sale Registration at Import Noting Section, Air Cargo Complex, Mumbai.

In terms of Para 2.38 of the Foreign Trade Policy (2015-2020), sale of goods on high seas for importation into India is permitted subject to the said policy or any other law for the time being in force.

In this regard, presently following documents are mandatorily prescribed for registration of High Seas Sale contract in the Import Noting Section of Air Cargo Complex (Import) Cornmissionerate, Mumbai.

  1. High Seas Sale Contract signed by both the buyer and seller and duly notarized. In the cases where the HSS contract is not notarized, the same is required to be attested by the authorized signatory of Bankers. The date of Contract /Notarization/Attestation by the bankers should not be later than the date of the IGM.
  1. Non-negotiable copy of Air Way Bill in original. If the same is riot available, then a photocopy of such Air Way Bill, duly authenticated by Air Line/Consoi Agent/Custom Broker.
  1. "High Seas Sale Invoice" and "Commercial Invoice" in original or a duly attested copy thereof.
  1. Authority letter for Customs Broker (CB) from High Seas sales buyer in original (if CB is appointed) or application from High Seas Sale buyer, addressed to the Deputy/Assistant Commissioner of Customs (Concerned Group/Import Shed as the case may be).
  1. IEC copies of both the Buyer and the Seller.

The issue was re-examined in light of various representations received from members of trade for discontinuation of mandatory registration of HSS agreement in Import Noting Section on the ground that the said registration process does not serve any useful purpose as all the aforesaid documents are also required to be submitted before concerned Assessment Groups/Import Shed.

In order to reduce transaction time & cost, prevalent overlap/duplication of functions and further ease the business process, the Customs has revised the procedures for registration of "High Seas Sale" transactions:-
